Selecting an Attorney

Selecting an attorney, regardless of the circumstance, is a decision that should never be taken lightly. In many cases concerning litigation, particularly matters of personal injury, mesothelioma, asbestos cancer lawsuits and such, the client/attorney relationship is a long and intimate one. It is imperative that one selects experienced legal representation that he or she feels comfortable with. Communication must be effective, personal information will have to be divulged, and some days will be better than others as far as health matters are concerned. You must have confidence in the fact that you have selected the asbestos attorney or mesothelioma law firm that is right for you. It is more than just a matter of “comfort.” The overall success or failure of your lawsuit may not only depend on the facts of your case but the relationship you have with your attorney.

Certain key elements must be considered and the Mesothelioma Crises Center has provided the following checklist to help assist you when selecting an attorney or law firm. You may desire to ask the following questions when deciding who will represent you and your best interests in your mesothelioma claim;

1) Is the law firm indeed a mesothelioma specialty law firm?

2) In the past five years, how many mesothelioma cases has the firm handled?

3) How many asbestos related or mesothelioma lawsuits does the firm handle currently or at any given time?

4) Is the law firm the primary law firm that will handle the case or are they a referral shop that will simply hand the case off to a litigation firm that will do the work?

5) If they are a referral firm, will they handle at least a portion of the subsequent litigation?

6) In the event that a second law firm will be handling the mesothelioma litigation, how can they be contacted?

7) Over the past five years, how many mesothelioma cases has the firm settled out of court and how many have gone to trial?

8) Are a summary of those verdicts readily available for review? 9) Who are the attorneys handling the mesothelioma litigation and were they directly involved in the summary of verdicts referenced above?

10) If the case cannot be settled out of court and a trial becomes necessary, does the firm have the litigation manpower and financial resources necessary or effectively handle the case or must they retain outside or assistant counsel?

11) Should litigation not be successful, does the firm possess a proper appeals department or will it be necessary for them to hire outside or assistant counsel?

12) Are their appeals attorneys appeal specialists or do they handle a variety of types of litigation?

13) Does the firm regularly appeal mesothelioma litigation?

You want our case assigned to an established specialty law firm staffed with mesothelioma attorneys who possess extensive experience representing victims of diseases caused by asbestos and other toxic materials in the workplace. You, as the client, want to be in direct contact with the legal team responsible for structuring and litigating your case from the incipient stage to the very end.

You should come away from your initial evaluation with a sense of confidence, knowing that the asbestos attorneys working on your behalf are doing just that, working on your behalf. Some states do not have law firms that specialize in asbestos litigation and mesothelioma claims, so it may be necessary to interview several firm before finding the one that is best suited to meet your needs, even if it means traveling to a nearby state. Mesothelioma a widespread medical problem that impacts thousands of lives, yet each case is unique in its own respects.

Seek out intelligent and aggressive lawyers who take pride in their work, ones who possess a humanistic understanding of mesothelioma litigation, not just a working knowledge of personal injury law. You must believe these attorneys are devoted professionals and they must be able to readily provide you with a referral sheet that details major victories in the field of mesothelioma law and asbestos litigation. Remember, they will be going up against corporate giants on your behalf so it is imperative that they have an established track record of success and are not simply “swinging for the fence” hoping to land a large verdict.

In the event that litigation is not necessary and the responsible party agrees to settle out of court, be assured that if they know you are backed by a strong team of trial attorneys they will more likely agree to a higher settlement than if you are represented by an inexperienced or “no name” firm. You want to be able to sit down at the negotiating table and operate from a position of strength, not desperation.

Never be afraid to ask questions. Your life and the well-being of your loved ones may depend on it.
